With things heating up in the Presidential race, one question on every gun owner’s mind is will the Harris/Waltz administration come after our guns if elected. In the first showdown with former President Donald Trump, Harris has done a 180 degree turnaround on her stance on a key legislation of gun reform called for by a many Democrats, the mandatory buy back program on all AR 15 platform rifles and AR Pistols, you could also reasonably presume that they would include AK style rifles and pistols as well. During the Presidential debate on September 10, Trump stated that if she is elected she would “confiscate everybody’s gun”. She quickly responded that she and her VP candidate Tom Mertz own guns and that “we’re not taking anyone’s guns away, so stop with the continuous lying about this stuff”. The moderators failed to press her on her stance of the mandatory buy back program that she openly supported during her first presidential run in 2019. Both candidates said that they are in support of Red Flag Laws. Currently there is the Federal Extreme Risk Protection Order Act (ERPO) enacted in 2021, which allows law enforcement and family members to petition a judge to temporarily remove a person’s access to firearms if they are considered a danger to themselves or others. The law also provides grants to help states and local governments implement red flag laws. The current Red Flag laws are modeled after domestic violence restraining orders (DVRO’s), allowing a judge to issue a temporary order that prohibits a person from purchasing and possessing firearms. One of Democratic running platforms (and presumably one of the Harris/Waltz running platforms), is Gun reform. In the wake of the recent school shooting in Winder, Georgia where a 14 year old student used an AR Style firearm to kill 4 individuals ranging from 14 to 53, and injured 9 others. Democrats are calling for more stringent laws for gun owners. However it did recently come to light that the 14 YO’s father had purchased the firearm for his son, this is said to have happened after authorities questioned the father and son about online threats he posted a year previously, that authorities did say was viable but failed to investigate any further. Since becoming Vice President in 2020 Harris has been appointed by President Biden to oversee the White House Office of Gun Violence Prevention, part of the Biden/Harris administration’s Bipartisan Safer Communities Act (BSCA) enacted in 2022. Since taking office in 2020 the Biden/Harris administration has had 1212 School related shootings where a gun is fired, brandished, or a bullet has hit school property regardless of the number of victims, time, day, or reason, compared to 352 during the Trump/Pence administration. One of the problems with gun reform is that it only seems to become a priority for certain groups of politicians during an election season. There are current laws in place when it comes to purchasing a firearm, whether it’s online or in person at a Firearm Retailer. Here in Florida you have to fill out a questionnaire and pass a background check in order to purchase a Firearm. If you possess a Concealed Carry Weapons (CCW) permit, then you are allowed to take immediate possession of the firearm, if you do not have a CCW then there is a 3 day waiting period before you can take possession of the firearm. There are loopholes to this law though, in that there are private sales in which a person may sell a personally owned firearm to another person without a background check, and without notifying law enforcement. This is how many trade shows, gun shows, and Flea Markets work where people are allowed to sell firearms without a Federal Firearms License (FFL) due to the fact that the firearms they are selling are supposed to be from their private collection and are not rotating firearms solely to make a profit. The ATF are doing their best to stop the private sellers in that they will investigate individuals who are rotating firearms that are supposed to be their private collections and selling them at trade shows, gun shows, and/or flea markets. However this is a long and drawn out process that takes months to years to complete, and let’s face it the ATF is an understaffed, underfunded organization. Harris has stated in the past that she supports defunding the police, and her track record seems to indicate that she is not a fan of American citizens owning certain types of guns. As of right now she supports the 2nd Amendment and says she is not taking anyone’s guns away. The question is can we trust her to not flip flop back to her previous views on gun control, once she is elected.
